About DAVID J. NOONAN, ESQ.
Attorney Noonan conducts the practice of law in Amherst, Massachusetts. He concentrates his practice in the areas of business law, corporate law, commercial litigation, business reorganizations and bankruptcy. He represents numerous corporations from the very large, such as Hitachi Engineering Co., Ltd. to smaller local companies such as an aerospace company, Aero Fastener Co., Inc. and Steve Lewis Subaru, Inc. He has represented numerous banks and commercial lenders documenting complicated secured lending transactions. He has formed numerous corporations focusing on structuring the ownership of assets so that equity holders are protected in the event of a business downturn. He has also formed limited liability companies to provide for complex investment structures in order to suit the needs of his clients.
He was formerly the commercial law and bankruptcy partner of the law firm Cohen Rosenthal P.C. in Springfield, Massachusetts. He was admitted to the Massachusetts Bar in 1977 and the North Carolina Bar in 1978. Mr. Noonan is also admitted to practice before the U. S. District Court for the Districts of Massachusetts, Connecticut, and the Eastern, Middle and Western Districts of North Carolina, the U. S. Court of Appeals for the First and Fourth Circuits and the United States Supreme Court. Mr. Noonan is also a former member of the panel of trustees for the U. S. Bankruptcy Court, District of Massachusetts.
A graduate of the College of the Holy Cross, Mr. Noonan obtained his Juris Doctorate from Suffolk University and his Masters of Law degree in international business law from the University of Exeter in England. In 1994 he passed the bankruptcy specialist certification examination, administered by the American Board of Certification of Washington, D.C. (“A.B.C.”) and received the A. B. C.’s certification as a commercial bankruptcy law specialist. That certification expired in the year 2000.
Mr. Noonan is a frequent lecturer at various Bar and business sponsored legal seminars concerning business, commercial law and bankruptcy. He represented the prevailing party in a case of first impression before the Massachusetts Supreme Court concerning the use of deeds in lieu of foreclosure in a real estate work out. J. & W. Systems, Inc. v. Shawmut First Bank & Trust, 413 Mass. 42 (1992).
He has served as counsel in several important bankruptcy cases such as In re Avenir Acquisition Corp. II, 139 B.R. 761 (Bankr. Mass. 1991), which was the first case in the 1st Circuit to determine a Bankruptcy Court’s right to conduct a jury trial. Additionally, he served as counsel in In re SPM Manufacturing Corp., 984 F.2d 1305 (1st Cir. 1993), a case of national first impression wherein the 1st Circuit legitimized a bank’s agreement to “carve out” dollars from its collateral and transfer the same outside of the bankruptcy estate to general unsecured creditors represented by a creditors committee.
He served as both Chapter 7 Trustee and counsel in the Indian Motorcycle Company Inc. bankruptcy in which he successfully prosecuted complex litigation in several jurisdictions throughout the United States and Europe. As result of his efforts, the assets of Indian Motorcycle were sold for more than $16 million.

My attorney in my recent bankruptcy was David Noonan, and I found him to be very professional and courteous. He took the time to explain the entire procedure and was very efficient. I hired Attorney Noonan after putting off what needed to be taken care of for years. He was very helpful and attentive. My case proceeded smoothly and I was in contact with him the entire time. Atty. Noonan has proven to exceed our expectations and hopes in his ability to assist us in our endeavor to lighten our debt burden. He is knowledgeable to the nth degree. He never hesitated to help us through our bankruptcy in whatever way that he could. We never felt as though we were being criticized or judged in any way by him. There is so much shame surrounding most individuals going through the bankruptcy process and his lack of judgment made it so much easier for us to go through this difficult time.
